All services are subject to agreed scope, timeline, and pricing.
2. BOOKING & PAYMENT
A retainer or deposit may be required to secure a project date
Remaining balance is due as agreed prior to or upon delivery
Late payments may result in delayed delivery
We reserve the right to cancel or reschedule services if payment terms are not met.
3. PROJECT CHANGES & CANCELLATIONS
Changes to scope may affect pricing and timeline
Cancellations may result in forfeiture of the retainer
Rescheduling is subject to availability
4. OWNERSHIP & COPYRIGHT
All photos, videos, and content created remain the intellectual property of Andy Hardeman Photography and Media.
Clients are granted a license to use the content, not ownership.
5. LICENSED USE
Unless otherwise agreed in writing, your license includes:
Website use
Social media use
Organic marketing
6. EXTENDED LICENSING
Additional licensing is required for:
Paid advertising (digital or print)
Commercial campaigns
Broadcast or large-scale distribution
Resale or third-party usage
Licensing terms will be outlined separately if applicable.
7. CLIENT RESPONSIBILITIES
Clients are responsible for:
Securing permissions for locations and properties
Preparing spaces for photography or video
Providing accurate project details
Obtaining consent from individuals appearing on camera
8. DELIVERY
Delivery timelines vary based on project scope
Final files are delivered digitally unless otherwise agreed
Raw files are not included unless specified
9. CREATIVE CONTROL
We retain creative control over:
Composition
Editing style
Final selection of delivered content
This ensures consistency with our brand and quality standards.
10. PORTFOLIO USE
Unless otherwise agreed in writing, we reserve the right to use all completed work for:
Portfolio
Website
Social media
Marketing and promotional purposes
11. LIMITATION OF LIABILITY
Andy Hardeman Photography and Media is not liable for:
Indirect or consequential damages
Loss of business or revenue
Third-party misuse of delivered content
Uncontrollable circumstances (weather, access issues, etc.)
12. WEBSITE USE
All content on this website is protected by copyright and may not be copied, downloaded, or used without permission.
13. THIRD-PARTY SERVICES
We may use third-party platforms (such as Pixieset or payment processors). We are not responsible for their policies or actions.
